1. Florian Razesberger, The International Criminal Court – The Principle of Complementarity, 201 S., 20061 herausgeberschaft
This book provides a brief overview of the historical roots of the International Criminal Court and explains the unique character and purpose of the principle of complementarity within the Rome Statute and its other constituent instruments. The author also examines article 17, the core provision in relation to complementarity, and describes its application in different phases of the proceedings before the ICC. This study tries to highlight the problematic issue of amnesties, which is not covered by the respective legal instruments, and questions the political and judicial implications of complementarity. This book is intended as a practical handbook rather than a theoretical inquiry.

 

2. Christian Wimpissinger, Steuerliche Verlustverrechnung nach EG-Recht, 280 S., 20062 herausgeberschaft
Die Schlechterstellung grenzüberschreitender Sachverhalte gegenüber solchen mit reinem Inlandsbezug verletzt regelmäßig die EG-Grundfreiheiten. Ob dies auch für steuerliche Einschränkungen der grenzüberschreitenden Verlustverrechung gilt, ist Thema dieses Buches. Den Schwerpunkt der Betrachtung bildet dabei die Verrechnung ausländischer Betriebstättenverluste und die Verlustverrechnung im internationalen Konzern. Vor der Entscheidung des EuGH in der Rechtssache Marks & Spencer hatte die herrschende Meinung Verlustausgleichsverbote im grenzüberschreitenden Kontext als gemeinschaftsrechtswidrig angesehen, was sich nunmehr teilweise geändert hat. Der Autor setzt sich insbesondere damit auseinander, weshalb die Grundsätze dieser Entscheidung nicht allgemein auf die grenzüberschreitende, steuerliche Verlustverrechnung übertragbar sind und inwieweit doch eine Rechtsprechungsänderung für den Bereich der direkten Steuern eingetreten ist.

 

3. Christina Knahr, Participation of Non-State Actors in the Dispute Settlement System of the WTO: Benefit or Burden?, 209 S., 20073 herausgeberschaft
The establishment of the new dispute settlement system in 1995 is undoubtedly one of the major achievements of the WTO compared to the GATT. However, there are still areas that need improvement. This study focuses on one of the controversial reform issues: the participation of non-state actors in WTO dispute settlement, in particular through submission of amicus curiae briefs. This book outlines the legal bases for such forms of participation, the pertinent practice of WTO Panels and its Appellate Body and gives an assessment of the position the WTO Members hold on this issue. Importand policy considerations surrounding this topic are also analyzed. Further the study provides a comparative analysis of non-state actor participation in international investment arbitration.
